Question about Posting Mixes
  • How do you go about putting together a mix compilation for readers to download from your blog?  If the songs being used are already free as downloads per the band/label, is it okay to include them as part of the mix without seeking consent?
  • I've gone with a yes to this question over the years without too much trouble. If the songs are *legally* available for free download already then putting them together into a mix shouldn't be a problem.
  • It seems like a lot of the mixes/podcasts use songs that aren't already available for free, but put them all together into one MP3 file. For these mixes, should you ask the label for permission to do so?
  • It really depends on what kind of relationship you have with the band/management/label for podcasts/single mixes.

I know a lot of the smaller podcasters don't ask permission, but they also tend to cover relatively unknown artists who appreciate the chance to be heard. Most people are too lazy to edit an mp3 out of a podcast to add it to their collection (especially when the download is instant and £0.79), so piracy is less of a problem than with individual mp3s.

You can also get a blanked license for podcasting (like radio), so if you want to be 100% legal - that is probably the easiest way. The cost can be prohibitive though.
